FAMOUSDOTS.COM RESERVES THE RIGHT TO MODIFY, CHANGE, OR DISCONTINUE ANY ASPECT OF THIS SITE OR THE SERVICES, INCLUDING BUT NOT LIMITED TO PRICES AND FEES, AT ANY TIME.

Account

To utilize certain features of this platform or access specific services, you are required to set up an account. By creating an account with famousdots.com, you confirm that the information provided is accurate, up-to-date, and complete. You also agree to keep your account details current and accurate at all times.

If famousdots.com finds any discrepancies or outdated information in your account, it reserves the right to suspend or terminate your access.

You are fully accountable for all activities conducted through your account, regardless of whether they are authorized by you. It is essential to safeguard your account credentials, including your username, password, payment methods, and any associated security PINs. For better protection, it is advisable to update your password and security PIN periodically, ideally every six months.

Should you detect any unauthorized access or security breaches involving your account, it is crucial to inform famousdots.com immediately. While famousdots.com is not responsible for any losses resulting from unauthorized activity on your account, you may be held liable for any damages caused to famousdots.com or third parties due to misuse or negligence related to your account.

Charges and Associated Expenses

Famousdots charges Sellers a fee (also referred to as “Commission”) for sales initiated and/or completed through Famousdots' Services. The standard fees and any updates will be posted on our website.

Once the Buyer and Seller agree on the terms for purchasing and selling a Domain, if the payment or transfer of the Domain fails for reasons unrelated to a breach of the Domain Transfer Agreement by Famousdots, Famousdots has the right to collect any applicable Commission fee from the party that failed to fulfil their obligation in completing the transaction. This includes Buyers who wouldn't typically incur such a fee. Additionally, the party not at fault may seek claims for damages or enforcement of the agreement from the party that failed to meet their obligations as outlined in these terms or the relevant Purchase Agreement.

Famousdots also reserves the right to impose a Marketplace Handling Fee, which is double (2x) the minimum commission for the respective Domain listing, in cases where it is evident that a User intended to harm the process. Such harmful intent may include, but is not limited to:

1. seeking to avoid paying Famousdots' Commission fees.
2. submitting a fraudulent or incorrect offer.
3. increasing the Reserve Price after an Auction has begun; or
4. obstructing the completion of the Domain purchase and sale.

Domain Marketplace Rules and Requirements

Both Buyers and Sellers are subject to the terms and conditions set forth in this Domain Marketplace Agreement, as well as any relevant policies regarding the listing, negotiation, purchase, and sale of Domains on the Famousdots Domain Marketplace. These policies can be found on the Website or in the Policies section.

Famousdots makes no representations or warranties concerning the characteristics of Domains listed on the Domain Marketplace, including, but not limited to, visitor or traffic data and the specific alphanumeric makeup of a Domain.

Legal Relationship between the party/s (Famousdots, Sellers, Buyers)

Famousdots is neither the owner of the Domains listed on the Domain Marketplace, nor does it exercise any control or influence over the transactions conducted between Users on the Domain Marketplace. Additionally, Famousdots does not act as an intermediary in relation to the Marketplace Services.

The responsibility for the content of Domain listings, including the accuracy of any statistics, whether provided by Famousdots or not, rests solely with the respective Sellers. Famousdots will not be held liable for any legal transactions or other actions of Users on the Domain Marketplace. This includes any infringement of third-party rights resulting from the use of Famousdots' Services, such as the listing of Domains that violate intellectual property rights, name usage rights, or trademark rights.

Both the Buyer and Seller agree that Famousdots shall not be held responsible for the failure of either party to fulfill their obligations under a Purchase Agreement, and that Famousdots, acting solely as a neutral facilitator of the Domain Marketplace and its related Services, shall not be liable for any claims arising from the attempted purchase or sale of Domains.
